Sometimes, yes. Older income tax debts can be discharged in bankruptcy if they meet specific rules:

  • The return was filed on time (or at least 2 years ago),
  • The debt is at least 3 years old.
  • The IRS did not record a tax lien.
  • The IRS assessed the debt at least 240 days ago. An assessment is an internal procedure in which the IRS records the tax debt. This process is not identical to a tax lien, and often occurs on a random basis.
